Les présentes Conditions Générales de Vente (CGV) régissent les ventes d’œuvres d’art originales, reproductions, impressions et autres produits proposés sur le site ChrysOakArtist.com.
Toute commande implique l’acceptation des présentes CGV par le client.
2. PRODUITS ET ŒUVRES
Les caractéristiques essentielles de chaque œuvre ou produit sont indiquées sur sa fiche : dimensions, technique, support, matériaux, caractère original ou reproduction, ainsi que son prix.
Les œuvres originales sont des pièces uniques.
Les photographies présentées sur le site sont réalisées avec le plus grand soin. Toutefois, les couleurs peuvent légèrement différer de l’œuvre originale en fonction notamment des réglages, de la luminosité et des caractéristiques de l’écran utilisé.
Ces différences de rendu ne constituent pas un défaut de conformité de l’œuvre.
3. PRIX ET PAIEMENT
Les prix sont indiqués en euros (€).
TVA non applicable.
Le prix applicable est celui affiché sur le site au moment de la commande.
Le paiement est effectué au moyen des solutions sécurisées proposées lors du passage de la commande, notamment par carte bancaire ou PayPal selon les moyens disponibles.
La commande n’est considérée comme définitive qu’après validation du paiement.
PAIEMENT EN PLUSIEURS FOIS
Pour certaines œuvres originales, un paiement échelonné sans frais peut être proposé sur demande préalable de l’acheteur et après accord de Chrys Oak Artist.
Les modalités du paiement échelonné, notamment le nombre d’échéances, leur montant et le calendrier de paiement, sont convenues par écrit entre Chrys Oak Artist et l’acheteur avant la validation de la vente.
Sauf accord contraire expressément convenu entre les parties, l’œuvre reste en possession de Chrys Oak Artist pendant toute la durée du paiement échelonné et n’est remise ou expédiée à l’acheteur qu’après paiement intégral du prix.
En cas d’interruption ou de défaut de paiement, les conséquences de l’annulation éventuelle de la vente et le traitement des sommes déjà versées sont déterminés conformément à l’accord conclu entre les parties et aux dispositions légales applicables.
4. EXPÉDITION ET LIVRAISON
Les œuvres originales disponibles sont généralement expédiées dans un délai de 5 jours ouvrés suivant la validation de la commande.
Les reproductions et impressions réalisées ou produites à la demande peuvent nécessiter un délai de production supplémentaire avant leur expédition.
FRANCE MÉTROPOLITAINE
La livraison standard est offerte pour les commandes expédiées en France métropolitaine.
HORS FRANCE MÉTROPOLITAINE
Les frais de livraison ne sont pas inclus dans le prix de l’œuvre ou du produit.
Pour toute livraison en dehors de la France métropolitaine, le client est invité à contacter Chrys Oak Artist avant son achat afin d’obtenir les conditions et le coût d’expédition correspondant à sa destination et à l’œuvre concernée.
Le montant peut varier notamment selon les dimensions, le poids, la destination, le transporteur et le niveau d’assurance nécessaire.
Une commande nécessitant une livraison hors France métropolitaine ne pourra être finalisée qu’après détermination des modalités d’expédition applicables.
Lorsque l’expédition le permet, un numéro de suivi est communiqué au client.
Les éventuels droits de douane, taxes d’importation ou autres frais exigés par le pays de destination sont à la charge du client, sauf disposition légale contraire.
5. RÉCEPTION ET DOMMAGES LIÉS AU TRANSPORT
Le client est invité à vérifier l’état du colis et de l’œuvre dès leur réception.
En cas de colis ou d’œuvre manifestement endommagé, le client est invité à prendre des photographies du colis avant son ouverture ainsi que de l’œuvre et de son emballage, à conserver les éléments d’emballage et à contacter Chrys Oak Artist dans les meilleurs délais à l’adresse theoaks@live.fr.
Lorsque cela est possible, le client est également invité à émettre des réserves précises auprès du transporteur en cas de dommage visible lors de la livraison.
Cette procédure facilite les démarches auprès du transporteur et ne prive pas le consommateur des droits et garanties dont il bénéficie en vertu de la législation applicable.
6. DROIT DE RÉTRACTATION
Conformément au Code de la consommation, lorsqu’il achète à distance un bien bénéficiant du droit de rétractation, le consommateur dispose d’un délai de quatorze (14) jours à compter de la réception du bien pour exercer ce droit, sans avoir à justifier sa décision.
Le client souhaitant exercer son droit de rétractation doit en informer Chrys Oak Artist avant l’expiration de ce délai par une déclaration claire et dénuée d’ambiguïté envoyée à :

Le client dispose ensuite d’un délai maximal de quatorze (14) jours à compter de la communication de sa décision de se rétracter pour retourner le bien.
Les frais directs de retour sont à la charge du client.
Compte tenu de la nature, de la fragilité et de la valeur des œuvres d’art, il est vivement recommandé d’effectuer le retour dans un emballage assurant une protection appropriée de l’œuvre et au moyen d’un mode d’expédition suivi et suffisamment assuré.
Le client est responsable de toute dépréciation du bien résultant de manipulations autres que celles nécessaires pour établir sa nature, ses caractéristiques et son bon état.
En cas de rétractation valablement exercée, le remboursement est effectué conformément aux délais et modalités prévus par la législation applicable.
Le remboursement peut être différé jusqu’à récupération du bien ou jusqu’à ce que le client fournisse une preuve de son expédition, la date retenue étant celle du premier de ces faits.
7. EXCEPTIONS AU DROIT DE RÉTRACTATION
Conformément aux exceptions prévues par le Code de la consommation, le droit de rétractation ne s’applique notamment pas aux biens confectionnés selon les spécifications du consommateur ou nettement personnalisés.
Cette exception peut notamment concerner une œuvre réalisée spécialement sur commande selon des caractéristiques, dimensions, couleurs, sujet ou autres spécifications expressément demandées par le client.
Le simple fait qu’une œuvre originale soit une pièce unique déjà existante ne supprime pas, à lui seul, le droit légal de rétractation lorsqu’il est applicable.
8. GARANTIES LÉGALES
Les produits vendus bénéficient des garanties légales applicables, notamment de la garantie légale de conformité lorsqu’elle est applicable et de la garantie contre les vices cachés, dans les conditions prévues par la législation française.
Ces garanties légales s’appliquent indépendamment de toute éventuelle garantie commerciale.
9. PROPRIÉTÉ INTELLECTUELLE
L’achat d’une œuvre originale ou d’une reproduction entraîne uniquement le transfert de la propriété du support matériel acheté.
Les droits de propriété intellectuelle et les droits d’auteur attachés à l’œuvre demeurent la propriété de Chrys Oak, sauf accord écrit exprès contraire.
L’achat d’une œuvre ne confère donc aucun droit de reproduction, représentation, adaptation, modification, exploitation commerciale ou diffusion de celle-ci.
Les œuvres, photographies, textes, illustrations et contenus présents sur ChrysOakArtist.com sont protégés par les règles relatives à la propriété intellectuelle.
Toute reproduction ou utilisation non autorisée est interdite.
10. RESPONSABILITÉ
Chrys Oak Artist ne saurait être tenue responsable d’un retard ou d’une inexécution résultant d’un événement de force majeure ou d’une circonstance extérieure échappant raisonnablement à son contrôle, sous réserve des dispositions légales impératives applicables.
Aucune disposition des présentes CGV ne peut avoir pour effet de priver le consommateur des droits qui lui sont accordés par la législation applicable.

12. MÉDIATION DE LA CONSOMMATION
En cas de litige, le client est invité à contacter préalablement Chrys Oak Artist afin de rechercher une solution amiable.
Si cette réclamation préalable n’aboutit pas, le consommateur peut recourir gratuitement au médiateur de la consommation dont relève Chrys Oak Artist :

13. DROIT APPLICABLE
Les présentes Conditions Générales de Vente sont régies par le droit français, sans priver le consommateur résidant dans un autre pays des dispositions impératives de protection dont il peut bénéficier en vertu de la législation applicable.
En cas de litige, une solution amiable sera recherchée en priorité, notamment par le recours au dispositif de médiation de la consommation lorsque celui-ci est applicable.

These Terms and Conditions of Sale govern the sale of original artworks, reproductions, prints and other products offered through ChrysOakArtist.com.
By placing an order, the customer accepts these Terms and Conditions of Sale.
2. PRODUCTS AND ARTWORKS
The essential characteristics of each artwork or product are stated on its product page, including dimensions, technique, medium, materials, whether it is an original or reproduction, and its price.
Original artworks are unique pieces.
Every effort is made to provide accurate photographs. However, colours may vary slightly from the original artwork depending on screen settings, brightness and display characteristics.
Such variations in colour rendering do not constitute a lack of conformity of the artwork.
3. PRICES AND PAYMENT
Prices are displayed in euros (€).
VAT is not applicable.
The applicable price is the price displayed on the website at the time the order is placed.
Payment is made using the secure payment methods offered during checkout, including credit card or PayPal where available.
An order is considered final only once payment has been successfully confirmed.
INSTALLMENT PAYMENTS
For certain original artworks, interest-free installment payments may be offered upon prior request from the buyer and subject to the approval of Chrys Oak Artist.
The installment payment terms, including the number of installments, their amount and the payment schedule, are agreed in writing between Chrys Oak Artist and the buyer before the sale is confirmed.
Unless expressly agreed otherwise between the parties, the artwork remains in the possession of Chrys Oak Artist throughout the installment payment period and will only be delivered or shipped to the buyer once the full purchase price has been paid.
In the event of interrupted or missed payments, the consequences of any cancellation of the sale and the treatment of amounts already paid will be determined in accordance with the agreement between the parties and applicable law.
4. SHIPPING AND DELIVERY
Available original artworks are generally dispatched within 5 business days following confirmation of the order.
Reproductions and prints made or produced to order may require additional production time before dispatch.
METROPOLITAN FRANCE
Standard shipping is free for orders delivered within Metropolitan France.
OUTSIDE METROPOLITAN FRANCE
Shipping costs are not included in the price of the artwork or product.
For delivery outside Metropolitan France, customers are requested to contact Chrys Oak Artist before purchasing in order to obtain the applicable shipping conditions and cost for the destination and artwork concerned.
Shipping costs may vary depending on the dimensions and weight of the artwork, destination, carrier and level of insurance required.
An order requiring delivery outside Metropolitan France may only be finalised once the applicable shipping arrangements have been determined.
Where available, tracking information will be provided once the order has been dispatched.
Any customs duties, import taxes or other charges imposed by the destination country are the responsibility of the customer, unless otherwise required by applicable law.
5. RECEIPT AND SHIPPING DAMAGE
Customers are encouraged to inspect the parcel and artwork immediately upon delivery.
If the parcel or artwork is visibly damaged, customers are encouraged to photograph the parcel before opening it, as well as the artwork and packaging, retain the packaging materials and contact Chrys Oak Artist as soon as possible at theoaks@live.fr.
Where possible, customers are also encouraged to make precise reservations with the carrier if visible damage is noticed upon delivery.
This procedure facilitates any claim against the carrier and does not affect the consumer’s statutory rights and guarantees.
6. RIGHT OF WITHDRAWAL
In accordance with French consumer law, where a distance purchase is subject to the statutory right of withdrawal, consumers have fourteen (14) days from receipt of the goods to exercise this right without having to provide a reason.
Customers wishing to exercise their right of withdrawal must notify Chrys Oak Artist before expiry of this period by means of a clear and unambiguous statement sent to:

The customer then has a maximum of fourteen (14) days from notification of the decision to withdraw to return the goods.
Direct return shipping costs are borne by the customer.
Due to the nature, fragility and value of artworks, customers are strongly advised to return the artwork using suitable protective packaging and a tracked shipping method with adequate insurance.
The customer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and condition.
Where the right of withdrawal has been validly exercised, reimbursement will be made in accordance with the time limits and conditions laid down by applicable law.
Reimbursement may be withheld until the goods have been recovered or until the customer provides evidence that they have been returned, whichever occurs first.
7. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the exceptions provided for under French consumer law, the right of withdrawal does not apply, in particular, to goods made to the consumer’s specifications or clearly personalised.
This exception may therefore apply to an artwork specially commissioned according to dimensions, colours, subject matter or other specifications expressly requested by the customer.
The fact that an existing original artwork is a unique piece does not, in itself, remove the statutory right of withdrawal where that right otherwise applies.
8. STATUTORY GUARANTEES
Products sold are covered by the statutory guarantees applicable under French law, including the statutory guarantee of conformity where applicable and the guarantee against hidden defects.
These statutory guarantees apply independently of any commercial guarantee that may be offered.
9. INTELLECTUAL PROPERTY
Purchasing an original artwork or reproduction transfers ownership only of the physical item purchased.
All intellectual property rights and copyright relating to the artwork remain the property of Chrys Oak unless expressly agreed otherwise in writing.
Purchasing an artwork therefore does not grant any right to reproduce, represent, adapt, modify, commercially exploit or distribute the artwork.
Artworks, photographs, texts, illustrations and other content displayed on ChrysOakArtist.com are protected by intellectual property law.
Any unauthorised reproduction or use is prohibited.
10. LIABILITY
Chrys Oak Artist shall not be liable for delays or failure to perform resulting from force majeure or circumstances reasonably beyond its control, subject to any mandatory statutory provisions.
Nothing in these Terms and Conditions shall deprive consumers of rights granted to them under applicable law.

13. GOVERNING LAW
These Terms and Conditions of Sale are governed by French law, without depriving consumers residing in another country of any mandatory consumer protection provisions to which they may be entitled under applicable law.
In the event of a dispute, the parties will first seek an amicable solution, including consumer mediation where applicable.
14. MODEL WITHDRAWAL FORM
